What Should You Know About Chapter 13 Bankruptcy?

As with any bankruptcy filing in Virginia, the court will put an automatic stay in place, immediately prohibiting creditors from continuous collection activities on your preexisting debt. This temporary injunction halts foreclosure proceedings, wage garnishment and other activity during bankruptcy. More importantly, it gives you the relief you need to stop the debt cycle.

The repayment plan is the center of Chapter 13 bankruptcy. Under the plan, you make a single monthly payment for a period lasting three to five years. When you successfully complete the repayment plan, most or all of your remaining unsecured debt is discharged.
